Dutch Copyright Law regarding
readers
Dutch Copyright Law is different from many other countries where
one important legislation point is concerned. Dutch legislation
states people are allowed to copy short sections of work or short
works in a publication which are to be used as a source of educational
information (like readers). The reader regulation concerns analogue
use whereby a regulation for digital use can also be arranged. However,
a number of conditions need to be satisfied

The Reader Agreements
The IPRO, together with the Dutch Publishers Association, has entered
Reader Agreements with the Dutch
umbrella organisations of the following educational institutions:

The VSNU (Vereniging van Nederlandse Universiteiten)
(Association of Dutch Universities) |
 |
The HBO (Higher Vocational Education) Board (on
behalf of Dutch Colleges) |
 |
The MBO Board (on behalf of Dutch intermediate
vocational education and adult education). |
These reader agreements provide detailed information regarding
a number of conditions included
in the Dutch Copyright Law, including the fact that copying short
sections and short works are allowed in educational publications.
This therefore defines the boundary between short and so-called
non-short sections and tariffs are agreed. These Reader Agreements
offer rightful copyright claimants the possibility to keep on top
of copying in readers. The PRO Association looks after the implementation
of the reader agreements and all applicable administration issues.
Educational institutions can pay PRO for any short sections copied
in readers. There are different types of regulations:

(Higher) Vocational Education and Universities
have paid for copying short sections in advance. They pay an
annual fee per student. |

Other institutions provide title specific information
regarding which materials they will be copying in readers. |
Control All educational institutions need to send a copy of each course pack to the PRO Association, which serves as proof of the level of copying. The PRO Association will check whether the Agreements have been adhered to by checking these proof copies and by regularly visiting the educational institutions.
Longer sections: educational
institutes request permission
Educational institutions need to obtain consent prior to publication
of the course pack for any copying of non-short sections. Educational
institutions can send a form to PRO for this purpose. PRO is authorised
by most publishers to also deal with these requests. The request
will be sent on to the relevant publishers if PRO does not have
authorisation to deal with a particular request.
